How long will my divorce take?
The average divorce takes about 10 months. This could be longer or shorter depending on the number of issues that go to trial or if you and your spouse can reach an agreement through mediation or an uncontested divorce.
Can I represent myself without an attorney?
Yes, although this isn’t recommended. In situations where a couple tries to reach a divorce agreement using an online company or paralegal, important issues may be overlooked which will cause serious problems down the line. A “Do It Yourself” divorce may seem like a good idea at first, but can often carry consequences over time. Call my office and discuss your situation in a friendly and confidential environment. At the least, an initial consultation with a qualified divorce attorney should be sought.
What sort of assets need to be divided in a divorce and how is it determined?
Assets include house, apartment or condominiums, automobiles, investments, securities, mutual funds, and pensions. This can be a difficult aspect of reaching an uncontested agreement. Keep in mind that any debt shared by a couple will also be divided such as mortgage payments, credit cards and other debt.
What are the definitions for the different kinds of child custody?
A seasoned child custody attorney can help you to understand the nuances of custody and how it is determined. The three different kinds of custody include:
- Temporary Custody – This is a court determined custody that lasts only as the divorce agreement is being determined.
- Legal Custody – The parent with legal custody has the right to make major decisions for the child. Legal custody can be shared, which is known as “joint legal custody.”
- Physical Custody – This determines the residence of the child. Where they will live and any visitation rights for the other parent. This can also be shared.

Can child custody be determined without the court making the final decision?

How is spousal support or “alimony” enforced in Alabama?
Once the court issues an order for alimony, they take no further action to make sure it is followed. They will act however if a request is made by one of the parties involved. Not paying ordered spousal maintenance can result in some serious penalties including a warrant for arrest and jail time.
